NEC Of A Party Is The Highest Organ Of A Political Party
The National Executive Council, NEC is the highest organ of any political party. The Supreme court has established that the NWC has no locus to remove the national Chairman of a party. It vested that power on the NEC.
In APC, when the tussle to remove Comr Adams Oshiomohle became difficult, with different courts making varying pronouncements, the NEC of the party was convened, which sat on June 25 and removed Oshiomohle.
After removing Oshiomohle, the NEC constituted a Caretaker Committee led by the Governor of Yobe state, Mai Mala Buni.
In the case of APC, it was not only Oshiomohle that was sacked. NEC sacked all the members of the NWC and constituted a Caretaker Committee.
Recall also that it was Victor Giadom, who convened the NEC meeting that sacked Oshiomohle. As at the time of APC crisis leading to Oshiomohle’s exit, Victor Giadom was purportedly sacked as Deputy National Secretary of APC. But he convened a NEC meeting that removed Oshiomohle.
In APGA, the NEC met yesterday and sacked Ozo Victor Oye and appointed an acting National Chairman, Chief Jude Okeke.
Oye in his drowning statement claimed that no one except himself can convene a NEC meeting. He forgot that by law, he was never the national chairman of APGA having withdrawn his own suit and injunction stopping Edozie Njoku from parading himself as the National Chairman of APGA.
That withdrawal puts Oye’s claim into doubt.
I have also read his boys claim that it is only the National Convention of APGA that can remove the National Chairman. That claim is also false. What the National Convention does is to ratify the decision of the NEC.
Now that Oye has been removed. It is expected that Jude Okeke will convene a National Convention to ratify their action and put in motion the process to elect a new national officers.
Victor Giadom, a sacked deputy national secretary of APC convened the NEC meeting, sacked Oshiomohle and INEC obeyed that singular decision.
